How does that involve you?
You, the public should be involved in decision-making. As people
become more aware of their environmental rights they will increasingly
know how to act when those rights become threatened. Fiona Ayerst
attorneys Inc can help from both a public participation viewpoint
and also a company viewpoint to neutralise confrontation and find
constructive solutions. We prefer to incorporate public input
into the planning process thereby establishing communication structures
for all stakeholders.
Amongst others we can assist the following clients:
-
Administrative officials
who have to do with many challenges such as which principles
to apply when issuing permits or keeping abreast of environmental
law;
-
The business sector
in how their business can keep abreast of the changes in environmental
law and how those changes can be addressed in day-to-day management.
Most importantly we can advise on how the public's reaction
to environmental issues be handled and how environmentally sensitive
developments should be approached. For many companies we give
advice on how to deal with historic pollution and what the financial
risks are in non-compliance with environmental laws.
-
Interested and affected parties the general
public needs to be empowered to protect themselves against
environmentally unacceptable impacts and need to be educated
on what their environmental rights are and how to avoid new
developments that could cause environmental degradation. We
often give advice on how effective action can be taken against
companies causing pollution and what damages are available to
the affected parties. In addition we give advice on forcing
the polluters to clean up the environmental degradation they
have caused and to monitor their actions and take corrective
steps.(see current cases for examples)
In general we would like to present our clients with a “win
– win” solution that allows all affected and interested
parties and the environment to benefit.
ISO 14001 Accreditation for companies
This is an internationally accepted standard for an environmental
management system (EMS). If your company is accredited by an appropriately
qualified agency this is internationally accepted as confirmation
of your ability to meet your stated environmental policy and aims.
Fiona Ayerst Attorneys will help you establish a basic, relatively
inexpensive EMS based on ISO 14001 principles. You will then be
in compliance with current environmental legislation assisting you
to prove the standard of your environmental management.
Risk control
Businesses must incorporate environmental issues in their planning
and in management. We offer our clients a logical and systematic
approach to identify and quantify the risks caused by environmental
law and the generation of structures that can control these risks.
We give our clients advice on the total legal framework that governs
environmental control in South Africa and interpret environmental
legislation in colloquial language. We generate solutions that
provide adequate protection against legal threats and we structure
systems to avoid civil and criminal liability. We are particularly
involved in financial implications of environmental decisions
and like to address these in our recommendations to our clients.
These may include things like assessments of environmental related
financial risks and quantification of environmental impacts.
