Divorce can be the most dramatic decision in your life, both for
you and your children. We give advice and assurance to ensure that
children are protected and your assets fairly and correctly divided.
In South Africa we have a central divorce court
(CDC). The CDC makes our system faster and simpler and so we prefer
to use it where possible rather than going to the High Court.
We can avoid long extensive trials in most cases and we prefer to
draft either settlement agreements between you alternatively to
refer you to mediation or alternative dispute
resolution.
Family law includes many different facets such as maintenance
enquiries, wills, ante nuptial contracts, liquidation & distribution
accounts, access rights applications, common-law contracts and partnerships,
customary partnerships and marriages and same sex partnerships and
contracts.
Also unmarried fathers have more rights these
days and our courts have started to take special note of the relationship
between the father and his child, even if he and mother are not
married.
Interdicts are now more readily available than
before through the CDC or the magistrates Court and can prevent
your spouse or ex-spouse from tampering with you or your property
and from threatening you and your family.
